The Shark Fin Sales Elimination Act (S. 1106) — a bill that targets the U.S. trade in shark fins — passed as part of a broader legislative package known as the United States Innovation and Competition Act (S. 1260). Similar legislation passed in the House of Representatives in the last legislative session and has been introduced in the House this session (H.R. 2811). It currently has more than 130 bipartisan cosponsors, Scuba Diver Life reported.
The Shark Fin Sales Elimination Act makes it illegal to possess, buy, sell or transport shark fins or any product containing shark fins, except for certain dogfish fins. There is an exception for shark fins lawfully taken with a license or permit under certain circumstances. Violators will be penalized under the Magnuson-Stevens Fishery Conservation and Management Act, with a maximum civil penalty of the greater of $100,000 for each violation or the fair market value of the shark fins involved.
The legislative move comes after studies about shark and ray populations highlighted a decline of more than 70 percent over the last 50 years. According to Oceana, over 73 million sharks are killed and traded annually. Demand for shark fin soup, especially in Asia, incentivizes overfishing and shark-finning — the act of removing a shark's fins at sea and throwing its body back overboard to drown, starve, bleed to death or get eaten. A Nature article, published earlier this year, listed overfishing as the primary cause and noted that three-quarters of species in this "functionally important assemblage" are now threatened with extinction. The researchers in the Nature study encouraged strict prohibitions and precautionary science-based catch limits to avoid population collapse and ensuing disruption of the ecological functions they serve.
The new bill aims to "close a loophole" that many advocates blame for the death of millions of sharks annually. According to Oceana, even though shark finning is illegal in U.S. waters, fins can still be bought, sold, and transported throughout the United States. Shark Stewards, a shark advocacy group, said "the USA contributes to the global decline of sharks" because "tons of shark fins from Latin America to Africa routinely pass through U.S. ports for report to Hong Kong, China and SE Asia." The group cited a National Resources Defense Council report from 2020 that estimated that fins from roughly 900,000 sharks passed through U.S. ports between 2010 to 2017.
Oceana reported that fins are often imported from countries that have inadequate protections in place for sharks and/or that violate international treaties to protect endangered species. Because of this, many shark advocates have been lobbying for years to close the trade loophole and to get the U.S. out of the business of shark fins completely.

Stefanie Brendl, executive director of shark advocacy group Shark Allies, told EcoWatch, "This bill is necessary and represents definite progress. We wholeheartedly support its passage and ask everyone in the conservation community to do the same." Brendl, a long-time advocate for shark conservation, noted positively that the legislation will "largely takes the US out of the fin trade" and that a series of global fin bans could collectively be the "best pathway to make an impact."
But, not everyone agrees. According to Seafood Source, the fishing industries in the U.S. have traditionally opposed bans, citing the country's successful management of shark fisheries.
"The United States has some of the best-managed shark fisheries in the world. Our laws and regulations prevent overfishing while maximizing commercial fishing opportunities and the economic value of our shark fisheries," Former National Marine Fisheries Service assistant administrator Chris Oliver said in a 2020 statement, the seafood industry report cited. "Part of our science-based management is allowing fishermen to sell both the meat and fins of sustainably harvested sharks."
Oliver argued that U.S. fin sales bans would not benefit management in U.S. waters and would have little impact on global trade.
Shark researcher and fisheries management expert David Shiffman has similarly advocated against blanket nationwide bans on the sale of shark fins. In 2017, Shiffman wrote in the journal Marine Policy about a prior, similar bill. He said, "While the proposed federal, nationwide ban's stated goal of conserving threatened shark populations is laudable and necessary, such a policy is misguided because it would A) undermine decades of progress made towards ensuring sustainable shark fisheries in the United States and around the world, B) likely have a negligible direct effect on global shark mortality, and C) contribute to the misconception that demand for shark fin soup is the only threat facing shark populations worldwide."
The scientist instead emphasized prioritizing policies that focus on sustainable shark fisheries management to achieve shark conservation.
Still, Brendl, of Shark Allies, said the trade ban was still "a really important development." She told EcoWatch, "Most legislation is not perfect, and compromises are often necessary to move the needle... No single piece of legislation will be the end-all solution... "
"Anything that slows down the fin trade will potentially help save millions of sharks. A key element will be if and how this will be enforced," she added.
Her non-profit advocacy group focuses on shark and ray conservation specifically by calling for an end to shark finning, the global trade of shark fins and products, including COVID-19 vaccines, that are made using sharks.
The second ocean-minded move the Senate undertook was to amend part of the United States Innovation and Competition Act to better address forced labor and Illegal, Unreported, and Unregulated (IUU) fishing. They cited concerns over whether seafood imported into the U.S. was legally caught and responsibly sourced, Scuba Diver Life reported.
Congressman Gregorio Kilili Camacho Sablan (MP-AL), who reintroduced the trade ban, applauded the actions in a statement. He said, "The strong, bipartisan support for this legislation sends a clear message that we have to pay more attention to protecting the Earth's oceans and the life within those oceans... Ultimately, all life on Earth depends on the health of the oceans."

The Italian NGO World Sustainability Organization launched the new "Whale-Safe" label in March via its Friend of the Sea project, which certifies fisheries, aquaculture, and tourism efforts as sustainable.
Run-ins with ships are a major cause of death and injury for whales. An estimated 80 whales die from ship collisions off the western U.S. annually. In the Mediterranean, one in five stranded whales recorded have marks from ship strikes. And while the International Whaling Commission (IWC) has compiled ship strike records from nearly every corner of the globe, these records are understood to be incomplete; crews on larger vessels may not notice if they hit a whale, and even observed strikes often go unreported.
With marine traffic increasing, these strikes have serious implications, particularly for vulnerable species. More North Atlantic right whales (Eubalaena glacialis) die from ship strikes and fishing gear entanglement than are born each year.
"Time is not on our side, and we need to act," said Paolo Bray, founder of Friend of the Sea, in an interview with Mongabay. Bray is also the European director of the California-based Earth Island Institute's Dolphin Safe Monitoring Program, which certifies that enrolled tuna companies outside the U.S. meet dolphin-safe standards.

The Whale-Safe certification requires participating large ships to meet criteria that increase the odds of spotting, avoiding and documenting whales. Vessels must have an observation system operating at all times. This could include a human observer, but Bray said an infrared camera system would be more effective by allowing constant monitoring, including at night and during poor weather when human vision is limited.
Participating vessels must have a protocol, approved by Friend of the Sea, for how to react when they sight a whale, though the certification does not dictate what that reaction should be. They must use some sort of digital platform to access and share sighting information with other vessels. Bray also added that vessels must report any whale collisions to the local coast guard and the IWC database. (There are no legal requirements to do so.)
Some whale experts expressed skepticism about these criteria. John Calambokidis, a research biologist studying human impacts on marine mammals at Cascadia Research Collective in Washington state, said the program's focus on sighting whales rather than attempting to keep ships from interacting with them in the first place may undermine its success.
"Their suggested solution seems almost completely focused on the idea of sighting and avoiding whales to reduce ship strikes, which has generally not been considered a particularly effective strategy," Calambokidis wrote in an email to Mongabay.
The challenge, Calambokidis said, lies in how difficult it is to spot whales at night and in poor weather. Infrared cameras of the sort Bray suggested for low-visibility conditions are currently in the testing phase and remain unproven, he said. Ships also have limited ability to take evasive action.
Instead, he said, most ship strike reduction strategies aim to slow ships down or reroute shipping lanes outside of whale habitat, which have proven benefits.
Whale-Safe will require vessels to comply with local regulations, including speed requirements and navigational routes specific to whales. The program will track compliance by collaborating with local agencies, or by using platforms that already track ships throughout their route. The goal, Bray said, is to "provide flexibility" by allowing ships to prove their compliance via services they already use.
Friend of the Sea plans to regularly publish a list of maritime companies that comply with Whale-Safe requirements. It also plans to release a study assessing the compliance of the biggest cruise and cargo operators.
The goal is to whip up public pressure as a way to galvanize companies to participate. "I think that once the consumers start to be aware of what is going on with whales, they will push for change," Bray said.

This strategy may be more effective for some types of maritime traffic than for others.
René Taudal Poulsen, an associate professor at the Copenhagen Business School, studies sustainability in maritime industries. He said current sustainability certification schemes for the shipping industry, which primarily focus on carbon emissions and air pollution, are most effective in consumer-facing sectors.
Container-shipping companies and cruise lines, for example, interact directly with the companies and travelers in their customer base. Their ships also often return to the same ports over and over. This creates a public-facing image that can be subject to community pressure. It also enables local incentive schemes, such as reduced dock fees in their home ports in exchange for cutting air pollution.
Yet the same inducements don't apply to tankers and bulk carriers, which together make up about half of all merchant maritime traffic. These large ships are run by many small companies with little public image. They travel globally, maintaining few ties with port communities, and have little motivation to work for local incentives.
"These initiatives are converting the pressure the port experiences from the port community, or converting the pressure that major branded goods experience from consumers, into incentives," Taudal Poulson said in an interview with Mongabay. "But the tankers and bulkers, they're transporting commodities like grain, iron ore, fertilizer — things you don't buy in a supermarket. So, public pressure has not been driving a lot of improvement so far."

"We want to face [companies] with the issue, and it's going to be a gradual process. We don't expect things to change immediately," Bray said. "But we hope by bringing through the media this issue to the surface, and also making the general public more knowledgeable about this problem, we think that gradually the approach of the companies will change."
If companies do volunteer to participate in Whale-Safe, and comply, the final challenge will lie in assessing how much of an effect the label truly has. Take the model for the new program, dolphin- safe tuna labeling. Dolphin deaths caused by the tuna fishery in the eastern Pacific Ocean have fallen drastically since the 1980s, from more than 100,000 per year to closer to 1,000. But experts attribute this improvement not only to dolphin-safe labels, but also to other measures enacted around the same time. These include the U.S. Marine Mammal Protection Act of 1972 and the La Jolla Agreement of 1990 that set limits on dolphin mortality in tuna fisheries.
If tuna fishing serves as a prototype, it seems clear shipping companies won't be able to label their way out of their whale collision problem. Reducing whale deaths is likely to require a much broader response.

With new backing from American Airlines, Virgin Atlantic and Microsoft, UK electric aircraft manufacturer Vertical Aerospace is innovating to make environmentally-friendly, accessible urban air travel a reality.
The startup created a zero-emissions vertical takeoff aircraft called the VA-X4 that can travel over 200 miles per hour and be "near-silent" in flight, the company said, CNN reported. A prototype of the electric Vertical Take-Off and Landing (eVTOL) with a range of over 100 miles is currently in production and has its first test flight planned for later this year.
"The X4 is going to be 100 times quieter than a helicopter, it's going to be zero-carbon, it's going to be a fraction of the cost. Most important of all, it's going to be 100 times safer, so this is going to open up urban air mobility to whole new range of passengers," founder and CEO Stephen Fitzpatrick said in a statement.
The company's mission to make air travel personal, on-demand and carbon-free eVTOLs like the X4 has the potential to transform both short, on-demand travel within cities that is currently accomplished via taxis and longer, medium-haul regional travel, Fitzpatrick told Yahoo! Finance. He estimated that a trip from downtown Los Angeles to LAX or from JFK International Airport to Manhattan would last only 12 minutes and cost roughly $40. Partners are already discussing commercial flight potentials out of large airports such as London Heathrow and Gatwick.
Rolls-Royce, the leading supplier of all-electric and hybrid-electric power and propulsion systems for aviation, will provide the electric engines. Honeywell, a leader in avionics and flight control systems, developed customized, state-of-the-art technology in the new flight vehicles.

According to CNN, Fitzpatrick also founded Ovo Group, which owns the UK's second-biggest energy retailer. The energy transition from fossil fuels to zero-carbon energy supplies is the "biggest challenge facing humanity today," the energy-tech entrepeneur said in a statement. At scale, the synergy of his two companies may actually help reduce the negative environmental impact of flying, which currently rates as one of the most detrimental activities for air quality and the climate.
"On an individual level, there is no other human activity that emits as much over such a short period of time as aviation, because it is so energy-intensive," said Stefan Gössling, co-editor of the book Climate Change and Aviation: Issues, Challenges and Solutions.
BBC estimated that aviation is responsible for around 2.4 percent of global carbon emissions and around 5 percent of global warming, due to nitrous oxides, water vapor, particulates and other airplane emissions that also have a warming effect. Other estimates place this figure between five and nine percent.
The relatively "small" aviation industry and an even smaller portion of the world that flies has been accused of having a disproportionately large, negative impact on the climate crisis. Climate justice advocates note that the flying populations are not the ones who will suffer the most from the climate crisis. These are some of the issues that Vertical Aerospace hopes to tackle.
"I love travelling. I love flying to new places. It cannot be that the way we're going to solve climate change is by asking everybody to do less, to travel less, to turn back time and forgo some of the advantages that technology has brought us," Fitzpatrick said. "I think that when people start to understand just how much better these vehicles are than what we have today, it's going to completely change how people think about flying through the skies."
"If we focus on finding the solutions, this will drive us towards the electrification of flight," he added. "This is the most exciting time in aviation for almost a century. Electrification will transform flying in the 21st century in the same way the jet engine did 70 years ago," he told CNN.
Each aircraft is worth as much as $4 billion, and Vertical Aerospace already has pre-orders for up to 1,000 VA-X4s, CNN reported. 250 of those will go to American Airlines, with an option for an additional 100. Virgin Atlantic has a pre-order option for up to 150, and Dublin-based aircraft leasing company Avolon has pre-orders and options for 500 of the new-age taxis.
"Our order with Vertical will... accelerate the inevitable commercial roll-out of zero emissions aircraft," CEO of Avolon Dómhnal Slattery said in the press release. "Before the end of this decade, we expect zero emission urban air mobility, enabled by eVTOLs, to play an increasingly important role in the global commercial aviation market."
The United Kingdom is already a global leader in aerospace innovation, Fitzpatrick noted. Unrelated blimp prototypes in the UK are similarly aiming to make air travel more environmentally-friendly and accessible.
"We're doing more than just developing an aircraft, we're actually creating an industry together," Mike Madsen, president and CEO of Honeywell Aerospace said in the statement.
According to Yahoo! Finance, Vertical Aerospace has secured several key partnerships and plans to list on the New York Stock Exchange after a merger with Broadstone Acquisition Corp, a special purpose acquisition company (SPAC), later this year. The latter was attracted to Vertical's highly commercial approach and clear route to market, the joint press release noted.
Hugh Osmond, chairman of Broadstone, said, "Transportation is one of the next big sectors of the global economy to be disrupted at scale. Vertical has a clear commercial plan to challenge short-haul air travel, and to create new markets where neither cars nor public transport can cope with demand."
According to CNN, Vertical believes the X4 will secure the same level of certification from the European Union Aviation Safety Agency as large commercial airliners, allowing production at scale. Commercial operations are slated to begin in 2024.
"This is probably the first commercial aircraft that most people will fly on that will have a zero carbon footprint, Fitzpatrick said. "We're going to look back at a time when we didn't have these vehicles flying over our skies. I think in five or six years' time, we'll be looking back thinking, 'I can't believe we didn't have this.'"
